Victory for Apple

Apple has scored a huge victory in its patent battle against Samsung when the jury in California found Samsung to violate a number of Apple patents. A nine-person jury in its verdict last week unanimously agreed with Apple and ordered Samsung to pay $1 billion. Most of the damages were tied to Samsung's smartphones. It rejected Samsung's counterclaims.

The award represents about 1.5 percent of Samsung's annual revenue. Analysts said the embarrassment of the verdict is a bigger blow for Samsung than the financial setback.

Moreover, Apple Inc. on Monday gave a federal judge a list of eight Samsung Electronics Co. products it wants pulled from shelves and banned from the U.S. market, including popular Galaxy model smartphones. The products Apple wants out are all smartphones: Galaxy S 4G, Galaxy S2 AT&T, Galaxy S2, Galaxy S2 T-Mobile, Galaxy S2 Epic 4G, Galaxy S Showcase, Droid Charge and Galaxy Prevail.

In an ironic twist, Samsung’s loss could be its gain, Enrique Gutierrez, chief technology officer of Digithrive, a Los-Angeles based Internet development and design firm, says: “Best billion dollar ad campaign Samsung ever had.”

Mobile Payments for Fast Food Restaurants

The summer of 2012 may go down in history as the season in which mobile payments began the long-overdue process of truly going mainstream in the U.S. 

McDonald’s has teamed up with PayPal to test a mobile payments service in France, according to a report from Reuters. The fast food chain also began training franchisees in the United States with its mobile payments platform, earlier this year, suggesting that the service may come to the U.S. soon as well.

Allowing for mobile payments at fast food restaurants is becoming more common these days. Last week, Dunkin’ Donuts launched a similar payment feature in the company’s new app. Burger King has also tested mobile payments.

Minimum for credit card transactions


You step up to the counter with a couple of small items and your credit card. Then you see the sign, often handwritten and taped to the register: "$10 minimum for credit card transactions."

Until 2011, most card networks prohibited merchants from setting minimums for credit card transactions, and even set up methods for consumers to turn in violators.

A coalition of retail and small business organizations asked Congress to change that. Because it costs retailers money to accept cards, small transaction amounts can make accepting cards unprofitable, especially at places such as convenience stores and gas stations, where profit margins are paper-thin. The key reasons the merchants pushed this law was based upon the fees they pay for credit card transactions.

Most Americans are less likely to carry cash and prefer to use credit and debit cards for convenience. For many stores, regular relationships and small buys often lead to larger purchases. The cost of handling a small transaction is worth the potential of a larger sale.

Black List


When consumers do not honor the terms of their credit agreements, the creditor may report the default to a credit reporting agency. If the consumer applies for additional credit, the new creditor obtains a credit report and learns about the consumer’s previous history. 

The merchant processing banks do not have a similar credit-reporting agency available that can report information about the way that a business handles its merchant processing responsibilities. The card associations, instead, use a file known as "MATCH." The MATCH File is a database file, previously and most commonly known as the Terminated Merchant File "TMF." MATCH acts as an invaluable tool to assess the potential risk prior to approving a merchant. It is essentially a BLACKLIST; and once a merchant is on this list it is highly unlikely that future Merchant Account applications will be approved. 

For a business or merchant to be added to the Match File they need to violate Visa and MasterCard rules in some way. The most common reasons include: 
· Fraud 
· Factoring (ringing sales for another business) 
· An excessive number of chargebacks 

The processing bank concludes that serious violations of the merchant agreement could result in increased loss exposure to itself or the credit card community. Once a merchant has been placed on The Match File only the processing bank that added them can remove them from it. The merchant must work with them directly to accomplish this.
